Separation in Poland involves only the abrogation of the marital community.

In order to obtain a separation, it is sufficient to recognize that there has been a complete, and not, as in the case of divorce, a complete and permanent dissolution of marriage between the spouses.

The main difference between divorce and separation in Poland is that after a divorce is pronounced, one can remarry, while after a separation this is not possible.

Obtaining a separation in Poland is usually easier than a court decree of divorce, but it is not just a formality. Despite the occurrence of a complete breakdown of marital relations, separation cannot be ordered if joint minor children are to suffer as a result, or there are other important obstacles, such as a serious illness of one of the spouses.
