How long does it take to get divorce in Poland?

How long divorce proceedings will take in Poland depends on the following several factors:

1) do you want to divorce under an agreement with your spouse? – if so, the court proceedings may last only one month;
2) whether you want to divorce by fighting a battle in court – fierce proceedings can last up to several years;
3) do you want the court to rule in the judgment that your spouse is to blame for the breakdown of the marriage?
4) do you have minor children? – if yes, and there is no agreement on contact between the children and the spouses, it will be necessary to appoint an expert to determine what custody plan best serves the welfare of the minor children;
5) do you have joint property with your spouse and there is no agreement between you on how to divide it between you.

In our experience, if there is no agreement between the spouses, court proceedings in Poland take on average between 9 months and 2 years. It also all depends on the location of the proceedings.
